Marriage and Divorce Laws in India
In India, marriage and divorce are regulated under personal laws based on religion, as well as secular laws applicable to interfaith or civil marriages.
Hindus (including Sikhs, Jains, and Buddhists) are governed by the Hindu Marriage Act, 1955.
Muslims follow Muslim Personal Law (Shariat) and relevant court precedents.
Christians are governed by the Indian Christian Marriage Act, 1872 and the Divorce Act, 1869.
Parsis are governed by the Parsi Marriage and Divorce Act, 1936.
Interfaith or civil marriages fall under the Special Marriage Act, 1954, which provides a secular framework for marriage and divorce.
